W-2 vs 1099 vs Statutory Employee
A W-2 Employee works for a company as part of its staff. The employer controls their schedule, provides the tools and resources, and withholds all payroll taxes (federal, state, Social Security, and Medicare). W-2 employees typically receive benefits like health insurance, paid time off, and retirement plans. Their paychecks already have taxes deducted, so they don’t have to worry about quarterly tax payments.
A 1099 Contractor works with a company, not for it. They’re self-employed — running their own business, setting their own hours, and providing their own tools. They’re paid the full amount for their work with no taxes withheld. Contractors are responsible for paying their own self-employment taxes, managing business expenses, and obtaining their own benefits.
A Statutory Employee is a hybrid between the two. They receive a W-2 but are treated like an independent contractor for certain tax purposes. Their employer withholds Social Security and Medicare taxes but not federal income tax. They can also deduct business-related expenses on their personal tax return — something regular W-2 employees can’t do.
